Canada is known for its welcoming immigration policies, and one such compassionate path is through Humanitarian and Compassionate (H&C) grounds. This special provision allows people who may not meet the regular immigration requirements to apply for permanent residency based on unique, compassionate reasons.

In 2023, Canada is looking to welcome a total of 92,290 refugees and newcomers on “humanitarian and compassionate grounds” (19.8% of Canada’s total 2023 immigration target). The following year, Canada aims to welcome 89,865 combined immigrants under these two categories (18.5% of the total immigration target for 2024).

Who can Apply?

The applicants who cannot get permanent residency in the already existing immigration programs can apply under this category. For application they must:

  • Clearly state the exemptions you are requesting in your application.
  • Explain why IRCC believe you should be granted these exemptions based on humanitarian and compassionate grounds.
  • Show compelling reasons, such as Best Interest of Child, Single Parent residing overseas for being allowed to apply for permanent residency from within Canada.

How to check your eligibility in this?

Here are some things that are taken into account for eligibility:

  1. Your strong ties in Canada: All your family is residing in Canada,  also you have build strong ties to the community, family, education, and involvement in social activities in Canada.
  1. Difficulties in Your Home Country: If you return back to your country, it will pose risks to your health or life due to political tensions, persecution, unemployment, or social issues, this is taken into account.
  1. Best Interest of Child: If you have children or grandchildren,  who are close to you and a separation from you will cause loss in their development. 
  1. Health Care: If your home country can’t provide the necessary healthcare or medical treatment, it’s an important factor.
  1. Family Separation: The potential separation from your family is also taken into account.
  1. Other Special Circumstances: Any other unique challenges or circumstances you’re facing are considered.

To strengthen your case, you’ll need to provide evidence which can strengthen your case.

  • Letters from family members describing the impact of your departure.
  • Letters from friends and the community showing your contributions.
  • Employment letters proving your income and work.
  • If you have children, documents illustrating their lives in Canada, such as school records and letters from teachers.
