UNLOCKING THE LMIA APPLICATION PROCESS

YOUR GUIDE TO HIRING FOREIGN WORKERS IN CANADA

Are you an employer in Canada looking to hire a foreign worker or a foreign worker eager to work in Canada? Understanding the Labour Market Impact Assessment (LMIA) is crucial. Here, we provide comprehensive insights into the LMIA process, highlighting key steps, eligibility criteria, and how to ensure a faster LMIA processing time.

In an effort to tackle labor shortages, the Canadian government has introduced the Recognized Employer Pilot this September. Under the Recognized Employer Pilot, qualifying employers will enjoy extended validity of up to 36 months for their Labor Market Impact Assessments (LMIAs) and a streamlined LMIA application process. The rollout of the Recognized Employer Pilot will occur in two distinct phases. Commencing in September 2023, primary agriculture employers will be the first to have the opportunity to apply, with all other employers becoming eligible to apply in January 2024. This development represents a significant step forward in enhancing the efficiency of Canada's foreign worker programs while addressing labor market needs.

UNDERSTANDING THE LMIA?

An LMIA is a vital document that assesses the impact of hiring a foreign worker on the Canadian labor market. It ensures that employing a foreign worker won’t harm Canadian employees. It’s a request from the employer to the Canadian government for permission to hire a foreign worker.

Navigating the LMIA Application:

The journey commences with the employer’s application to ESDC. We help you in enlisting the comprehensive snapshot of the job offer, including job responsibilities, salary details, and working conditions.

As ESDC meticulously evaluates the application to ensure that hiring a foreign worker is not just necessary but beneficial for the Canadian labor market. Therefore, careful analyses of the application by experts help in channelizing the smooth process.

Checking the Eligible factors:

Employers: Any Canadian employer can apply for an LMIA if they can’t find a Canadian to fill the job. They must demonstrate an immediate need and financial capability.

Foreign Workers: Foreign workers must have a positive LMIA from their prospective employer to apply for a work permit.

When LMIA is not required:

Some circumstances allow hiring a foreign worker without an LMIA, such as the International Mobility Program, offering LMIA-exempt work permits. Examples include Intra-Company Transfer, Free Trade Agreement, International Experience Canada, Global Talent Stream, and Researcher Work Permit.

LMIA EXEMPT WORK PERMIT:

This work permit allows foreign workers to start working in Canada without the employer obtaining an LMIA.
